1. Who we are

FPS Tweaks is offered by EK Goods ("we", "us"). Our full business details are in the Legal notice. You can reach us at [email protected].

These terms apply when you buy or use FPS Tweaks. By buying or using it, you agree to them.

2. What you can buy

FPS Tweaks Panel (one-time purchase)

A lifetime license for the version of FPS Tweaks that is current when you buy it. It includes every tweak and tool in that version and free bug-fix updates for it: if you buy version 1.0.8, you also get 1.0.9, 1.0.10 and every later 1.0 version. You download them from the Download page. Versions with new features (1.1, 1.2 and so on) and automatic updates come with FPS Tweaks Pro.

FPS Tweaks Pro (monthly subscription)

Everything in FPS Tweaks Panel, plus Game Mode and every new version, for as long as your subscription is active. The subscription renews automatically every month and is charged to your payment method until you cancel.

You can cancel anytime on the Account page. Pro keeps working until the end of the period you already paid for. After that, FPS Tweaks no longer applies tweaks or runs Game Mode, and you no longer get new versions; Pro does not turn into a Panel license. The tweaks you applied stay in place, and you can always undo them, even without an active license.

Remote Setup (one-time service)

We connect to your PC over AnyDesk while you're there, install and set up FPS Tweaks, optimize Windows for your hardware and fine-tune the settings of your games. It works with a Panel or Pro license, which you buy separately. After you pay, we email you to pick a time. We only connect during the session we agreed on, and you can end it anytime.

3. Your license

• Each license key works on one PC at a time. To move it to another PC, email us your license key and we free it from the old PC. The next time FPS Tweaks on the old PC checks your license, it stops applying tweaks; it can still undo them.
• The license is personal. You may not sell, share, rent or publish your license key.
• You may not copy, modify, decompile or reverse engineer FPS Tweaks, or get around its license checks, except where the law allows this.
• FPS Tweaks and all rights in it stay ours. You get a right to use it, not ownership of it.

4. Prices and payment

Prices are in euros and include VAT. Customers in the United States, and in other countries that use the US dollar, pay in US dollars. Payments are processed by Stripe. If we change the price of Pro, we tell you at least 30 days before it applies to you, and you can cancel before then.

5. Delivery and right of withdrawal

You receive your license key right after payment, on screen and by email. When you buy, you ask us to deliver it right away and confirm that you lose your 14-day right of withdrawal once the key is delivered. See the Refund Policy for when we refund anyway.

For a Remote Setup, you ask us at checkout to start the setup before your 14-day withdrawal period ends and confirm that you lose that right once the setup is done. Until your session starts, you can cancel for a full refund. If you end the session partway, we refund the part we didn't do.

6. What FPS Tweaks does

FPS Tweaks changes Windows and graphics-driver settings to improve gaming performance. Before it changes a setting, it saves the current value, so you can undo each tweak and the saved values are put back. When System Protection is turned on in Windows and the restore point option in the app's Settings is on (it is by default), it also creates a Windows restore point before your changes, once a day.

• Undo puts back the settings FPS Tweaks saved. Some things can't be brought back, and the app says so next to the tweak before you apply it: for example, Recall snapshots that a tweak deletes. The cleanup tools delete temporary files and caches; deleted files can't be restored.
• Results depend on your hardware, software and games. We don't promise a specific FPS gain or latency improvement.
• Every tweak's trade-offs are described next to it in the app, and tweaks marked "Advanced" ask you to confirm first. Only use them if you understand the trade-off described.
• FPS Tweaks does not modify game files or game memory. Game publishers and anti-cheat providers set their own rules, and we can't control or guarantee how they treat third-party software.
• FPS Tweaks is not affiliated with Microsoft or with any game publisher.

7. Liability

We build FPS Tweaks carefully, but we can't guarantee it works on every PC or without errors. To the extent the law allows, our liability is limited to the amount you paid us in the 12 months before the damage occurred. This limit does not apply to damage caused intentionally or through gross negligence, to death or personal injury, or where the law doesn't allow limiting liability. Your statutory rights as a consumer are not affected.

8. Ending a license

We may deactivate a license if it was bought fraudulently, if the payment is refunded, reversed or charged back, or if the key is shared or resold. Where possible, we tell you first. FPS Tweaks can still undo the tweaks it applied after that.

9. Changes to these terms

We may update these terms, for example when we add features. A Panel purchase keeps the terms that applied when you bought it. For Pro, we email you about important changes at least 30 days before they apply, and you can cancel before then.

10. Law and disputes

These terms are governed by the law of the Netherlands. If you are a consumer in the EU, you also keep the protection of the mandatory laws of your own country. Please contact us first if something is wrong. We'll do our best to solve it.
